These Terms and Conditions (“Terms”) govern the subscription services provided by Dr Arsy Corporation (“we,” “us,” or “our”). By subscribing to our services, you (“Subscriber” or “you”) agree to the following terms and conditions.

 

 

1.1. Subscriptions are automatically billed on a recurring basis. You are solely responsible for ensuring that your payment method is valid and up to date. Dr Arsy Corporation will not be held liable for failed transactions due to expired or incorrect payment information.

1.2. The subscription will be billed on the same day each month, corresponding to the date of the original purchase. If payment is not received due to a failed transaction, Dr Arsy Corporation reserves the right to cancel your subscription immediately and seek compensation for any financial losses or fees incurred as a result of the failed transaction.

1.3. Accepted payment methods include Amazon Pay, Apple Pay, all major credit cards, and PayPal. Dr Arsy Corporation is not responsible for any processing errors or fees imposed by your payment provider.

1.4. By entering into a subscription, you authorize Dr Arsy Corporation to charge the provided payment method on a recurring basis. Dr Arsy Corporation will not be held responsible for any overdraft fees, charges, or penalties incurred as a result of automatic billing.

1.5. Subscription Activation: Your subscription will officially begin upon payment confirmation. Under no circumstances will Dr Arsy Corporation be held liable for delays caused by payment verification processes.

 

 

2.1. You may cancel or modify your subscription at any time before the product is shipped. It is solely your responsibility to ensure that cancellations are made in a timely manner. Failure to cancel before shipping will result in you being charged in full for that shipment.

2.2. If the product has already been shipped, you may cancel within 7 days of receiving it. A $20 return and handling fee will apply. Dr Arsy Corporation will not refund any shipping costs incurred in the original shipment.

2.3. Upon cancellation, a prepaid return label will be provided via email. It is your responsibility to return the product in its original, unopened condition. Failure to do so may result in forfeiture of any refund eligibility.

2.4. If the product is returned within 7 days, you will be refunded, less the $20 cancellation and handling fee. You agree to waive any right to dispute these fees once cancellation is requested.

2.5. Cancellation or modifications must be managed through your online account at DrArsy.com. Dr Arsy Corporation is not liable for cancellations that fail due to technical errors on the customer’s part.

 

 

3.1. If a payment fails, you have 7 days to provide a new payment method. After 7 days, your subscription will be canceled. Dr Arsy Corporation is not liable for any losses you may incur due to this cancellation, and you will not be refunded for any missed shipments or services during this period.

3.2. If you wish to restart your subscription after cancellation, you may be charged at the current subscription price if there have been any price changes since your original subscription. Dr Arsy Corporation reserves the right to refuse service to customers with repeated payment failures.

3.3. Any customer attempting to circumvent payment by initiating chargebacks, disputes, or any fraudulent behavior will be held fully liable for all legal and financial damages incurred by Dr Arsy Corporation, including but not limited to legal fees, collection costs, and penalties. We reserve the right to immediately cancel any subscription and take legal action.

 

 

4.1. You are responsible for ensuring that your payment methods and shipping addresses on file are accurate and up to date. Dr Arsy Corporation is not responsible for failed shipments or missed deliveries due to incorrect information provided by the customer.

4.2. Dr Arsy Corporation is not responsible for subscription interruptions or cancellations caused by outdated payment information. The customer assumes full responsibility for updating their account information in a timely manner.

4.3. Data Privacy: We take reasonable measures to protect your personal and payment information stored in our database. However, you acknowledge that no system is 100% secure, and Dr Arsy Corporation shall not be held liable for any unauthorized access, hacking, or data breaches. By subscribing, you agree to the storage of your payment details, and Dr Arsy Corporation shall not be held liable for any data breaches beyond its control. You waive any right to pursue legal action against Dr Arsy Corporation for such incidents.

 

 

5.1. Shipping is free for all subscription orders. Dr Arsy Corporation reserves the right to change shipping carriers and methods at any time without prior notice to the customer.

5.2. If there is a delay or if the product is out of stock, we will notify you, and you will have the option to either cancel your subscription for a full refund or wait for the product to become available. Dr Arsy Corporation is not liable for any inconvenience caused by these delays, and the customer waives any right to claim damages.

5.3. Single-unit purchases are subject to regular shipping fees. Dr Arsy Corporation is not responsible for any additional shipping costs, taxes, or duties that may apply to your location.

 

 

6.1. Returns or refunds are allowed for subscription purchases within 7 days of receiving the product. However, the customer assumes full responsibility for initiating the return within the specified period. Dr Arsy Corporation will not process returns requested after the 14-day window.

6.2. If the product is defective or damaged upon arrival, you are entitled to a full refund or replacement. However, you must provide photographic evidence of the defect or damage within 7 days of receiving the product. Failure to do so will result in the denial of the refund.

6.3. All returns and refunds must be initiated through DrArsy.com for purchases made directly on the website. Any return requests submitted through third-party platforms will not be honored.

6.4. Customers may request refunds an unlimited number of times. However, each refund request will incur a $20 handling and shipping fee. Dr Arsy Corporation reserves the right to refuse further services to customers who abuse the refund policy.

 

 

7.1. You may pause your subscription at any time without limitations on the duration. However, Dr Arsy Corporation is not liable for any service interruptions or product availability issues that arise during the paused period.

7.2. Pausing can be managed directly through your account profile on the website. It is the customer’s responsibility to manage the pause and resume functionality of their account.

 

 

8.1. Subscription prices are locked in at the rate applicable at the time of subscribing. However, Dr Arsy Corporation reserves the right to change pricing for future subscriptions or for customers who cancel and then resubscribe.

8.2. Future price changes will not affect existing subscriptions, but if a customer reactivates a subscription after cancellation, they will be subject to the new pricing structure. Dr Arsy Corporation is not liable for any discrepancies in pricing that may arise due to payment method changes or subscription modifications made by the customer.

 

 

9.1. Discount codes and promotional offers may be used for the initial purchase only and cannot be applied to subsequent subscription renewals. Dr Arsy Corporation reserves the right to deny any discount or promotional offer if deemed inappropriate or fraudulent.

9.2. Discount codes are limited to one-time use per customer. Any attempts to use multiple codes or circumvent this policy will result in immediate cancellation of the subscription, without refund.

 

 

10.1. Subscriptions automatically renew at the end of each billing period (monthly, bimonthly, quarterly, or every six months). By agreeing to these Terms, you waive any right to dispute the automatic renewal process and the associated charges.

10.2. Your payment method on file will be charged for renewals. It is the customer’s responsibility to ensure the payment method is valid. Dr Arsy Corporation is not responsible for any failed charges or overdraft fees that may occur as a result of automatic renewals.

10.3. You are solely responsible for managing your subscription and ensuring your payment method is up to date. Any failure to do so will not be the responsibility of Dr Arsy Corporation.

10.4. By agreeing to these Terms, you accept full responsibility for all aspects of your subscription, including automatic renewals, and waive any liability for Dr Arsy Corporation.

 

 

11.1. Dr Arsy Corporation reserves the right to cancel your subscription at any time without prior customer approval. This includes but is not limited to cases of fraudulent activity, repeated payment failures, abusive customer behavior, or any violation of these Terms.

11.2. Customers will be notified of the cancellation and the reason for it within 7 days of the next shipment or subscription renewal date. Failure to receive this notification will not hold Dr Arsy Corporation liable for any lost services or products.

11.3. Subscriptions or orders can be canceled for reasons including, but not limited to, fraudulent activity, repeated payment failures, or product unavailability. Dr Arsy Corporation reserves the right to ban customers who repeatedly violate these policies.

 

 

12.1. In the event of long-term unavailability, we will notify you 7 days before your next renewal with options to pause or cancel the subscription. If you fail to respond, your subscription will automatically be paused, and no refund will be issued for the downtime.

12.2. In cases of unavailability, Dr Arsy Corporation reserves the right to recommend alternative products. You are not entitled to any refunds or compensations for delays or unavailability unless explicitly stated by Dr Arsy Corporation.

12.3. Dr Arsy Corporation is not responsible for any dissatisfaction caused by temporary or permanent unavailability of any product.

 

 

13.1. Dr Arsy Corporation shall not be held liable for lost or damaged shipments, incorrect addresses provided by the customer, or delays caused by shipping couriers, natural disasters, or other circumstances beyond our control. The customer assumes full responsibility for providing accurate shipping information and ensuring safe receipt of the product.

13.2. By subscribing, you agree that Dr Arsy Corporation’s liability is limited to the cost of the product purchased. You waive any right to pursue legal action for any damages that exceed the product value.

13.3. Under no circumstances will Dr Arsy Corporation be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the product, even if Dr Arsy Corporation has been advised of the possibility of such damages.

 

 

14.1. International customers are eligible for subscriptions. However, Dr Arsy Corporation is not responsible for any customs duties, taxes, or shipping delays that may occur. The customer assumes full responsibility for complying with the import laws and regulations of their country.

14.2. Shipping and handling policies for international customers will be the same as for domestic customers. However, Dr Arsy Corporation reserves the right to adjust shipping fees for international orders at any time.

 

 

15.1. Our products are intended for external use only. If you have known skin sensitivities or allergies, consult a dermatologist before using our product. The customer assumes all risks related to the use of the product.

15.2. Dr Arsy Corporation shall not be liable for any adverse reactions, allergic reactions, or misuse of the product. By subscribing, you acknowledge that you are responsible for understanding the ingredients and potential risks associated with the product.

15.3. Dr Arsy Corporation does not guarantee specific results from using its products, including but not limited to improvements in skin conditions. Results may vary by individual. Any claims of dissatisfaction or ineffectiveness will not result in refunds or compensation.

15.4. Dr Arsy Corporation will not be held liable for any misuse of the product, and any resulting medical conditions or skin issues will be the sole responsibility of the customer.

 

 

16.1. Dr Arsy Corporation respects your privacy and will take appropriate measures to ensure the security of your personal and payment information. However, no system is entirely secure, and the customer assumes full responsibility for any risks associated with online transactions.

16.2. Your data will be processed in accordance with our privacy policy and will not be shared with third parties without your consent, except as required to fulfill your subscription. By subscribing, you acknowledge that you waive any right to pursue damages related to data breaches or unauthorized access to your information.

 

 

17.1. In the event of changes to the product formulation, size, or packaging, you will be notified in advance. You agree to accept any product changes unless explicitly canceled in accordance with the cancellation policies outlined in these Terms.

17.2. You will have the option to cancel your subscription without penalty, provided you follow all applicable policies outlined above. Dr Arsy Corporation will not be held liable for any dissatisfaction caused by product changes.

 

 

18.1. There are no limits to how many times you may request a refund, but each refund request will incur a $20 handling and shipping fee. Dr Arsy Corporation reserves the right to refuse refunds for customers who abuse the refund process.

18.2. Any refund request made outside of the stated period will not be honored. Dr Arsy Corporation will not be held liable for any losses you may incur due to missed refund opportunities.

 

 

19.1. If a customer initiates a chargeback or dispute after a subscription order has shipped, Dr Arsy Corporation reserves the right to recover all costs related to the dispute, including legal fees and handling costs. Customers initiating chargebacks in bad faith will be subject to immediate termination of their subscription, and Dr Arsy Corporation reserves the right to pursue legal action for damages.

19.2. Chargebacks made in bad faith, or fraudulent chargebacks, will result in immediate termination of the subscription and may lead to legal action. The customer agrees to cover all associated fees, legal costs, and penalties resulting from such actions.

 

 

20.1. Dr Arsy Corporation may suspend a customer’s subscription if there is suspected fraudulent activity or if payment issues arise. The customer waives any right to dispute the suspension in such cases.

20.2. A 7-day notice will be provided before suspending the subscription. However, Dr Arsy Corporation reserves the right to suspend without notice if fraud or serious violations are suspected.

20.3. Dr Arsy Corporation is not liable for any legal claims related to subscription suspensions, and all liabilities fall on the customer if fraudulent activity or payment issues are suspected.

 

 

21.1. Subscriptions are non-transferable and cannot be assigned, transferred, or resold to any third party. Any attempt to transfer or assign a subscription will result in immediate cancellation without refund, and Dr Arsy Corporation reserves the right to pursue legal action for damages.

21.2. Customers attempting to transfer or resell subscriptions will have their subscriptions canceled immediately, and Dr Arsy Corporation reserves the right to ban such customers from future services. All associated fees and penalties will be the responsibility of the customer.

 

 

22.1. By subscribing, you agree to indemnify, defend, and hold harmless Dr Arsy Corporation from any claims, liabilities, damages, expenses (including legal fees), or other losses arising from your use or misuse of the product, violation of these Terms, or any third-party claims related to your subscription. You assume full responsibility for any claims that arise from the improper use of our products or violation of these Terms.

22.2. The customer waives any right to pursue legal action against Dr Arsy Corporation for issues arising from product use, subscription management, or data security breaches, except in cases of gross negligence.

 

 

23.1. Dr Arsy Corporation reserves the right to modify or discontinue the subscription service at any time without prior notice to customers. You agree to waive any claims or damages resulting from service modifications or cancellations.

23.2. Customers will not be allowed to modify subscription terms on their own; all modifications must be approved and made by Dr Arsy Corporation. Any unauthorized attempts to modify subscriptions will result in immediate cancellation without refund.

 

 

24.1. The product is sold “as is,” and Dr Arsy Corporation makes no warranties, express or implied, about the product’s suitability for any particular purpose or the results customers may achieve from using it.

24.2. Dr Arsy Corporation disclaims all liability for any claims related to the product, and the customer assumes all risks associated with the use of the product.

24.3. Under no circumstances will Dr Arsy Corporation be liable for any indirect, incidental, or consequential damages, even if advised of the possibility of such damages. The customer agrees to limit any claims to the purchase price of the product.

 

 

25.1. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remainder of the Terms will continue in full force and effect. The customer agrees to waive any right to dispute the enforceability of the remaining Terms.

25.2. Dr Arsy Corporation reserves the right to modify or replace invalid provisions with terms that closely approximate the original intent, without affecting the validity of the rest of the agreement.

 

 

26.1. Customers can reactivate canceled subscriptions, but they will be charged at the current subscription price. Dr Arsy Corporation is not obligated to honor previous pricing or terms for reactivated subscriptions.
